The Government of Canada is currently seeking applications from diverse and talented Canadians from across the country who are interested in the following positions:
Lay Members (part-time positions)
Competition Tribunal
The Competition Tribunal is a specialized tribunal that combines expertise in economics and business with expertise in law. The Tribunal is an independent adjudicative body. The cases it hears are complex and deal with matters such as mergers, misleading advertising, and restrictive trade practices. Matters before the Tribunal are usually of national interest, can involve significant financial stakes and directly impact on the competitiveness of private enterprise and industry.
A Lay Member’s responsibilities include:
- Undertaking the review of submissions and reports, participating in hearings before the Tribunal (listening to evidence and arguments, examining facts and expert testimony, and questioning and clarifying arguments of legal counsel and experts);
- Participating in panel deliberations, analysing evidence and arguments, and determining matters under Part VIII of the Competition Act using independent, impartial judgment based on evidence;
- Drafting Tribunal decisions with other panel members, ensuring that proper economic, business, commercial and financial analysis is reflected in those decisions;
- Developing and maintaining professional knowledge of relevant business/economic theory, research, national and international trends, and related jurisprudence; and
- Attending the Tribunal’s members’ meetings and professional conferences, reading Tribunal decisions as they are distributed, and adhering to the Tribunal’s rules.

Per Diem: $715 - $840
Official Languages and Diversity

To be considered for one of these positions, please provide examples from your career that clearly demonstrate how you meet the following requirements in your application:
Education and Experience
- A post-graduate degree in economics, business, commerce or finance, or a professional designation such as Chartered Accountant;
- A post-graduate degree in industrial economics would be considered an asset;
- Significant private or public sector or academic experience directly related to business, commerce, finance, accounting or economics;
- Experience in reviewing and analyzing jurisprudence, legal and economic arguments, industry studies and expert testimony; and
- Experience in applying expert evidence to determine the merits of cases in the context of competition law would be considered an asset.
If you are selected for an interview, the following criteria will be assessed:
Knowledge, Skills and Abilities
- Knowledge of the Canadian economy and marketplace;
- Knowledge of the Canadian business/economic competitive environment;
- Knowledge of global economic environment and trends;
- Knowledge of the history, content, intent and jurisprudence related to the Competition Act;
- Knowledge of national and international trade agreements, practices and other relevant tribunal decisions would be considered an asset;
- Highly developed analytical skills to analyze voluminous, lengthy, and complex economic and legal material;
- Ability to examine and assess facts and legal arguments pertaining to complex business conduct and competition law;
- Ability to apply legislation, jurisprudence and precedents to deal with new situations or cases;
- Excellent oral communication skills to formulate questions to counsel and witnesses that probe the validity of arguments or evidence, and to determine the merits of applications with other panel members who have diverse professional backgrounds; and
- Excellent writing skills to participate in the drafting of reasons for panel decisions and/or for dissenting opinions.
Language Requirements
Proficiency in both official languages would be preferred.

Eligibility Factors and Conditions of Employment
In your application, it will be important that you confirm you meet the following requirements:
- Every member of the Tribunal shall, before entering on the duties of his office, take an oath that he will duly and faithfully, and to the best of his skill and knowledge, execute the powers and trusts reposed in him as a member of the Tribunal (statutory).
- No member of the Tribunal shall take part in any matter before the Tribunal in which the member has a direct or indirect financial interest (statutory).
- Every member of the Tribunal must be willing to commit to be available to participate as a Tribunal member, on an “as required” basis, often without much notice.
- Every member of the Tribunal must be willing to travel across Canada, as required, for extended periods of time.
