Copyright Board Canada

The Copyright Board of Canada is an economic regulatory body that derives its mandate from the Copyright Act. As a quasi-judicial tribunal, the Board is empowered to establish, either mandatorily or at the request of an interested party, the royalties to be paid for the use of copyrighted works when the administration of such works is entrusted to a collective society. The Copyright Board Canada also has the right to supervise agreements between users and licensing bodies and issues licenses when the copyright owner cannot be located.

The Copyright Board Canada has been central to the most high-profile copyright matters of the past decade, namely: music streaming, peer-to-peer file sharing, internet service provider liability, iPod or other device levies, and the use of literary works. Members chair and participate in decision-making panels regarding copyright tariff applications. In this role, Members analyze and weigh evidence to render decisions jointly with the Vice-Chairperson that provide for fair and equitable royalties to be paid to copyright collective societies for the use of works protected by copyright.

Education and Experience

• A degree from a recognized university in a relevant field of study, such as law, economics, social sciences or public administration, or an acceptable combination of relevant education, job-related training and/or experience;
• Experience in the field of economic regulation, intellectual property valuation or copyright use;
• Experience in the interpretation and application of legislation;
• Experience in providing legal or economic advice would be considered an asset; and
• Experience with a quasi-judicial tribunal, would be considered an asset.

If you are selected for an exam and an interview, the following criteria will be assessed:

Knowledge, Skills and Abilities

• Knowledge of the mandate and activities of the Copyright Board;
• Knowledge of the cultural, communication and information technologies industries, their regulatory regimes and their economic environments;
• Strong knowledge of the Copyright Act and other related legislation in addition to knowledge of administrative law, the principles of natural justice and the rules and practices followed by quasi-judicial tribunals in Canada;
• Ability to analyze all aspects of a case, interpret and apply the relevant criteria, while using judgment to identify key issues, with a view to making lawful, fair and equitable decisions;
• Ability to reconcile divergent stakeholders' positions, taking into account associated social and economic implications; and
• Superior communication skills, both written and oral, with the ability to write clear and concise notes, analyses and decisions.

Language Requirements

Proficiency in both official languages is required.

In your application, it will be important that you confirm you meet the following requirements:

• Candidates appointed to one of these positions shall not, directly or indirectly, engage in any activity, have any interest in a business, or accept or engage in any office or employment that is inconsistent with their duties as a Member of the Copyright Board Canada (statutory).
• Candidates appointed to one of these positions must have the ability to understand, during hearings, evidence in English and French, without the assistance of an interpreter.
• Candidates appointed to one of these positions must be willing to travel to the National Capital Region to participate in hearings and decision making.
