Chairperson (part-time position)

Canadian Cultural Property Export Review Board

The Canadian Cultural Property Export Review Board (Review Board) is an arm’s length administrative tribunal, established under the Cultural Property Export and Import Act. Among its various responsibilities, the Board certifies cultural property for income tax purposes. In this role, it makes determinations with respect to the "outstanding significance and national importance" and the fair market value of objects or collections donated or sold to designated Canadian museums, art galleries, archives and libraries. The Review Board also reviews appeals of applications for export permits that have been denied. If it determines that the property for which an export permit has been denied is of "outstanding significance and national importance", it establishes a delay period of between two and six months during which the property must remain in Canada. During this period, designated institutions and public authorities are notified of the availability of the property and may request a Movable Cultural Property Grant to assist with the purchase of cultural property in order to keep it in Canada.

The Chairperson is accountable to lead the Review Board, consisting of the Chairperson and not more than nine other members, in fulfilling its mandate of interpreting and administering specific provisions of the Cultural Property Export and Import Act through the conduct of independent and transparent decision-making functions aimed at supporting the preservation of our Canadian heritage.

Per diem: $475 - $550

Education and Experience

  • A degree from a recognized university in a relevant field of study or an acceptable combination of education, job-related training and/or experience;
  • Experience on a board of directors/trustees, preferably as a chairperson;
  • Experience at the senior management level within the private or public sector;
  • Experience in the interpretation and application of legislation within the context of an administrative proceeding;
  • Experience in the development of strategies, objectives, plans, best business practices and in corporate governance;
  • Experience in financial and human resources management;
  • Experience in dealing with the federal government, preferably with senior government officials, would be considered an asset; and
  • Experience in the operation of an administrative tribunal would also be considered an asset.

If you are selected for an interview, the following criteria will be assessed:

Knowledge, Skills and Abilities

  • Knowledge of the Cultural Property Export and Import Act, and the mandate and activities of the Canadian Cultural Property Export Review Board (Review Board);
  • Knowledge of the roles and responsibilities of the Chairperson, the Review Board and its Secretariat, the Administrative Tribunals Support Service of Canada (ATSSC), and the Department of Canadian Heritage;
  • Knowledge of the procedures and practices involved in conducting an administrative hearing and the principles involved, particularly as they relate to natural justice and fairness;
  • Knowledge of sound governance principles, strategic planning, the monitoring of performance, and the federal government’s expectations regarding accountability and reporting;
  • Knowledge of the social, economic and cultural environment in which museums, libraries, archives, collectors and dealers operate in Canada would also be considered an asset;
  • Ability to lead an arm’s length administrative tribunal and define its strategies and objectives in order to carry out its mandate in accordance with the Cultural Property Export and Import Act;
  • Ability to effectively conduct meetings and hearings of an administrative tribunal in order to lead strategic discussions, foster debate among Review Board members, facilitate consensus and manage conflicts;
  • Ability to interpret the provisions of various statutes, regulations, policies and other documents in order to render decisions on outstanding significance and national importance and of fair market value;
  • Ability to provide functional direction and maintain effective relationships with the Review Board’s Secretariat, who are employees of the ATSSC; and
  • Superior communication skills, both written and oral, including the ability to develop and maintain effective relationships with senior government officials, the Review Board’s key stakeholders and the media.

Language Requirements

Proficiency in both official languages would be preferred.
