Transportation Appeal Tribunal of Canada

As an administrative tribunal with quasi-judicial powers, the Transportation Appeal Tribunal of Canada has the responsibility for processing and deciding reviews and appeals of certain decisions by Transport Canada and the Canadian Transportation Agency.

The Chairperson interprets and administers the provisions of the Transportation Appeal Tribunal of Canada Act, the Aeronautics Act, the Railway Safety Act, the Canada Transportation Act, the Canada Shipping Act, the Marine Transportation Security Act and any other federal act relevant to the Transportation Appeal Tribunal of Canada, thus providing the transportation community with the opportunity to have enforcement and licensing decisions reviewed by an independent body. The Chairperson also has supervision over, and direction of, the work of the Tribunal, including the apportionment of work among Member and the assignment of Members to hear matters brought before the Tribunal, and, when the Tribunal sits in panels, the assignment of Members to panels and to preside over panels; and generally, the conduct of the work of the Tribunal and the management of its internal affairs.

The Vice-Chairperson supports the Chairperson with the interpretation and administration in the provisions of the Transportation Appeal Tribunal of Canada Act, the Aeronautics Act, the Railway Safety Act, the Canada Transportation Act, the Canada Shipping Act, the Marine Transportation Security Act and any other federal act relevant to the Transportation Appeal Tribunal of Canada, thus providing the transportation community with the opportunity to have enforcement and licensing decisions reviewed by an independent body.

In the absence or incapacity of the Chairperson, or if the office of the Chairperson is vacant, the Vice-Chairperson acts as Chairperson during the continuance of that absence or incapacity or until a new Chairperson is designated.

Salary range (Chairperson): $174,700 to $205,500 (GCQ-6)

Salary range (Vice-Chairperson): $124,300 to $146,200 (GCQ-4)

Position Location: National Capital Region (statutory)

Education and Experience

  • Candidates interested in being considered for the Chairperson and/or Vice-Chairperson position(s) must have:
    • A degree from a recognized university in a field of study related to transportation, such as aeronautics, rail or marine, or an acceptable combination of education, job-related training and/or experience;
    • A degree in law or at least five years’ standing at the bar of any province or territory, or with the Chambre des notaires du Québec would be considered an asset;
    • Experience developing, maintaining, and managing successful working relationships;
    • Decision-making experience, ideally with respect to complex technical issues;
    • Experience in one of the federally regulated transportation sectors (aeronautics, rail, motor vehicle, marine), or as a medical practitioner; and
    • Experience in the interpretation and application in a quasi-judicial context of the Transportation Appeals Tribunal of Canada Act, the Aeronautics Act, the Canadian Aviation Regulations, the Railway Safety Act, the Canadian Transportation Act, the Canada Shipping Act, the Marine Transportation Security Act, and/or any other federal Act relevant to the Transportation Appeal Tribunal of Canada.
  • Candidates interest in being considered for the Chairperson position must additionally have:
    • Management experience, preferably at the senior executive level, in a public or private sector organization, including managing financial and human resources; and
    • Experience in management, labour or industrial relations at a senior level.

Knowledge, Skills and Abilities

  • Candidates interested in being considered for the Chairperson and/or Vice-Chairperson position(s) must have:
    • Knowledge of transportation modes;
    • Knowledge of relevant transportation legislation, including the Transportation Appeal Tribunal of Canada Act, the Aeronautics Act, the Canadian Aviation Regulations, the Railway Safety Act, the Canadian Transportation Act, the Canada Shipping Act, the Marine Transportation Security Act, as well as relevant guidelines and manuals;
    • Knowledge of the transportation community system, including in-depth knowledge of the particular mode of transportation;
    • Knowledge of the rules of procedure in the area of administrative justice;
    • Ability to perform the adjudicative functions of a Member of the Transportation Appeal Tribunal of Canada; and
    • Ability to communicate effectively, both orally and in writing.
  • Candidates interested in being considered for the Chairperson position must additionally have:
    • Knowledge of organizational management principles;
    • Superior communication skills, both written and oral, and ability to represent the Transportation Appeal Tribunal of Canada with Members, the public, governments, and other organizations;
    • Ability to define the objectives and strategies of the organization; and
    • Ability to motivate Members and staff.

Language Requirements

Proficiency in both official languages would be preferred.

Eligibility Factors and Conditions of Employment

  • If appointed, you shall not accept or hold any office, membership, employment or interest, or engage in any business activity, that is inconsistent with the proper performance of your duties and functions (statutory).
  • If appointed, you must devote the whole of your time to the performance of your duties and functions as prescribed by the Transportation Appeal Tribunal of Canada Act (statutory).
  • If appointed, you must reside in or be willing to relocate to the National Capital Region, or to a location within a reasonable commuting distance (statutory).
  • If appointed, you must be able to accept a significant travel schedule.
  • Appointees must comply with the Ethical and Political Activity Guidelines for Public Office Holders throughout their appointment as a term and condition of employment. The guidelines are available on the Governor in Council Appointments website, under Forms and reference material.
  • All appointees will be subject to the Conflict of Interest Act. Public office holders appointed on a full-time basis must also submit to the Office of the Conflict of Interest and Ethics Commissioner, within 60 days of appointment, a confidential report in which they disclose all of their assets, liabilities and outside activities.
