Vice-Chairperson (full-time position)

Copyright Board Canada

The Copyright Board Canada is an economic regulatory body that derives its mandate from the Copyright Act. As a quasi-judicial tribunal, the Board is empowered to establish, either mandatorily or at the request of an interested party, the royalties to be paid for the use of copyrighted works when the administration of such works is entrusted to a collective society. The Copyright Board Canada also has the right to supervise agreements between users and licensing bodies and issues licenses when the copyright owner cannot be located.

The Copyright Board Canada has been central to the most high-profile copyright matters of the past decade, namely: music streaming, peer-to-peer file sharing, internet service provider liability, iPod or other device levies, and the use of literary works. The Vice-Chairperson is the Chief Executive Officer of the Board and is responsible for planning, administering, monitoring and evaluating the main activities of the Board. The Vice-Chairperson also participates in hearings, analyzes and weighs evidence, and works with other Members to render joint decisions that provide for fair and equitable royalties to be paid to copyright collective societies for the use of works protected by copyright.

Salary Range: $142,800 - $168,000 (GCQ-5)

Education and Experience

• A degree from a recognized university, preferably in law, economics, social sciences or public administration, or an acceptable combination of relevant education, job-related training and/or equivalent experience;
• Demonstrated leadership at the executive level in a successful private or public sector organization, including managing human and financial resources to achieve desired results;
• Experience in developing and implementing an organizational vision reflective of the organization’s role and capacity or experience in a changing environment;
• Experience in the field of economic regulation, intellectual property valuation, copyright use or legal analysis would be considered an asset; and
• Interaction with a quasi-judicial tribunal in Canada would be considered an asset.

If you are selected for an exam and an interview, the following criteria will be assessed:

Knowledge, Skills and Abilities

• Knowledge of the cultural, communication or information technologies industries, their regulatory regimes, their economic environments and the particular opportunities and challenges of the digital economy in Canada;
• Knowledge of copyright, administrative law, the principles of natural justice;
• Excellent management and leadership abilities, as well as the ability to analyze complex situations in order to develop strategies and make suitable decisions, while anticipating their short- and long-term impact;
• The ability to analyze all aspects of a case, interpret and apply the relevant criteria with a view to making lawful, fair and equitable decisions as well as the ability to conduct a fair and efficient quasi-judicial hearing is required; and
• Superior communication skills, both written and oral, with the ability to write clear and concise notes, analyses and decisions.

Language Requirements

Proficiency in both official languages is required.

• The candidate appointed to this position shall not, directly or indirectly, engage in any activity, have any interest in a business, or accept or engage in any office or employment that is inconsistent with their duties as a Member of the Copyright Board Canada (statutory).
• The candidate appointed to this position must reside in or be willing and able to relocate to the National Capital Region, or to a location within a reasonable commuting distance.
